Data Use Policy

INTRODUCTION AND SCOPE

This Data Use Policy explains how Furva, a service operated by Nuvotech Consulting LLC d/b/a Furva ("Furva," "we," "us," or "our"), collects, uses, processes, analyzes, shares, retains, and derives value from information provided through or generated by the Service.

This Policy supplements our Privacy Policy and Terms of Service and is intended to provide additional transparency regarding our use of veterinary laboratory reports, pet information, biomarker data, AI-generated outputs, analytics, aggregated information, and other data processed through the Service.

The purpose of this Policy is to explain the rights, responsibilities, permissions, and limitations that apply to the use of data within the Furva platform, including our use of information for service delivery, artificial intelligence functionality, research, analytics, product development, platform improvement, referral services, telehealth-related activities, and other lawful business purposes.

This Policy also describes how Furva may create, use, retain, and commercialize de-identified, anonymized, aggregated, statistical, and derived data in accordance with applicable law and the consents provided by users.

By creating an account, uploading information, using the Service, or providing any required consent, you acknowledge that your information may be processed in accordance with this Data Use Policy, our Privacy Policy, and our Terms of Service.

OWNERSHIP OF USER DATA

Furva respects users' ownership rights and recognizes that users may submit veterinary laboratory reports, pet information, and other content through the Service.

2.1 Ownership of Uploaded Data: You retain ownership of the veterinary laboratory reports, documents, files, and other information that you upload to the Service ("Uploaded Data"). Nothing in this Policy transfers ownership of your Uploaded Data to Furva. By uploading information to the Service, you grant Furva the rights necessary to store, process, analyze, display, transmit, and otherwise use such information for the purpose of operating, maintaining, securing, improving, and providing the Service and its related features in accordance with our Terms of Service, Privacy Policy, and this Data Use Policy.

2.2 Ownership of Pet Information: You retain ownership of the pet information you provide through the Service, including information relating to your pet's identity, breed, age, sex, medical history, laboratory results, and other pet-related information. You represent and warrant that you have the authority to provide such information and to grant the permissions described in this Policy. Furva may use and process pet information as necessary to provide platform functionality, generate AI-powered outputs, facilitate referrals and future telehealth-related services, perform analytics, and carry out other activities described in this Policy.

2.3 Ownership of AI-Generated Outputs: Subject to applicable law and the rights of third-party technology providers, users may access and use AI-generated summaries, educational insights, trend analyses, and other outputs generated through the Service for their personal use in connection with managing their pet's health information. However, Furva retains all rights, title, and interest in and to the underlying Service, artificial intelligence systems, algorithms, models, software, methodologies, workflows, prompts, data processing techniques, and technology used to generate such outputs. Nothing in this Policy grants any ownership interest in Furva's intellectual property, artificial intelligence systems, or proprietary technology.

Furva may continue to use the knowledge, improvements, learnings, statistical information, de-identified data, and derived insights generated through operation of the Service for product improvement, research, analytics, artificial intelligence development, and other lawful business purposes as described in this Policy.

DATA REQUIRED TO PROVIDE THE SERVICE

Certain information is required for Furva to provide its core functionality and operate the Service. Without this information, we may be unable to process veterinary laboratory reports, generate AI-powered outputs, maintain user accounts, facilitate referrals, provide support, or otherwise deliver the services users request.

Required information may include account information, pet information, veterinary laboratory reports, extracted biomarker data, AI-generated summaries, technical information necessary for platform operation, and other information reasonably required to provide the Service.

By using the Service and submitting information through the platform, you authorize Furva to collect, store, process, analyze, transmit, and use such information as necessary to provide requested functionality, maintain platform operations, improve service performance, protect security, comply with legal obligations, and carry out the activities described in our Terms of Service, Privacy Policy, and this Data Use Policy.

Processing required to operate the Service is separate from any optional data uses that may require your consent. Where consent is required for specific uses of information, Furva will provide appropriate notices and choices in accordance with applicable law.

USER CONSENT AND DATA USE CHOICES

Furva is committed to providing users with transparency and meaningful choices regarding how their information is used. Certain processing activities are necessary to provide the Service, while other uses may be based on your voluntary consent.

4.1 Required Data Processing: Certain information must be processed in order for Furva to provide the Service and its core functionality. This includes processing necessary to create and manage accounts, store and analyze veterinary laboratory reports, generate AI-powered summaries, maintain pet health records, facilitate referrals and platform services, provide customer support, ensure security, and comply with legal obligations. Because these activities are necessary for the operation of the Service, they cannot be disabled while you continue to use the Service.

4.2 Optional Data Use Consent: Furva does not currently require users to participate in research activities involving identifiable user information or identifiable pet information in order to access or use the Service. If Furva introduces research studies, future research programs, research partnerships, scientific initiatives, analytical projects, publications, or similar activities that involve identifiable user or pet information, participation in such activities will be entirely voluntary.

Any participation in identifiable-data research activities will require the user's affirmative opt-in consent. Such consent will be requested separately from required service-related processing, will not be pre-selected, and will not be a condition of creating an account, maintaining an account, or using the Service. Users may choose whether to participate and may decline without affecting their access to the Service.

Furva may also use de-identified, aggregated, transformed, statistical, benchmarking, and derived information for analytics, research, artificial intelligence improvement, product development, commercial insights, and other lawful business purposes as described in this Policy and the Data Use Policy.

4.3 Withdrawal of Consent: Where processing is based on your consent, you may withdraw that consent at any time by updating your account settings, adjusting your communication preferences, or contacting us using the methods identified in this Policy. Withdrawal of consent will apply only to future processing activities and will not affect the lawfulness of processing conducted before the withdrawal became effective.

4.4 Effect of Withdrawal: If you withdraw consent for identifiable-data research activities, Furva will discontinue the applicable future processing activities to the extent required by law. However, withdrawal of consent will not require Furva to delete, modify, reverse, or unwind information that has already been de-identified, aggregated, transformed, incorporated into analytical datasets, used in research, included in statistical or benchmarking information, or integrated into artificial intelligence models, systems, or product improvements before the withdrawal became effective.

Certain information may also continue to be retained and processed where necessary to provide the Service, comply with legal obligations, enforce agreements, protect rights and security interests, or satisfy other lawful business purposes.

DE-IDENTIFICATION AND ANONYMIZATION PRACTICES

Furva may create de-identified, aggregated, transformed, statistical, benchmarking, and derived information from data processed through the Service. These processes are designed to remove, redact, transform, obscure, or otherwise eliminate information that could reasonably identify an individual user or pet while preserving the usefulness of the data for research, analytics, product development, artificial intelligence improvement, benchmarking, and other lawful business purposes.

Veterinary laboratory reports uploaded to the Service may initially be stored and processed in their original form. Furva does not treat uploaded reports as de-identified solely because they have been uploaded to the Service. Instead, de-identified datasets may be created through a separate de-identification process that removes or reduces identifying information before it is used in de-identified datasets or related activities.

Depending on the nature of the information, the de-identification process may involve the removal, redaction, transformation, or suppression of identifiers and reasonably identifying metadata, including owner names, clinic names, contact information, microchip numbers, account identifiers, and other information that could reasonably be used to identify a user, pet, household, veterinary provider, or specific individual.

De-identified information may be created from veterinary laboratory reports, biomarker data, pet information, usage data, AI-generated outputs, and other information collected through the Service. Such information may be combined with information from other users to create aggregated datasets, benchmarking information, statistical reports, trend analyses, research datasets, and other derived information.

Furva takes reasonable technical, administrative, and organizational measures designed to ensure that de-identified information cannot reasonably be associated with, linked to, or used to identify a particular user or pet. These measures may include data minimization practices, access controls, processing safeguards, operational procedures, and other controls designed to reduce the risk of re-identification.

Furva maintains internal policies and controls intended to prohibit the re-identification of de-identified information except where necessary to comply with applicable law, respond to lawful governmental requests, protect legal rights, investigate security incidents, or otherwise as legally permitted. Furva does not intentionally attempt to re-identify de-identified information for commercial, marketing, profiling, or similar purposes.

Where Furva shares de-identified information with service providers, business partners, research partners, investors, potential transaction counterparties, or other authorized recipients, Furva may require such parties through contractual or other legally binding obligations to use the information only for authorized purposes and not attempt to re-identify the information.

Furva may use, retain, disclose, license, commercialize, and otherwise exploit de-identified, aggregated, transformed, statistical, benchmarking, and derived information for lawful business purposes, provided that such information does not reasonably identify a user or pet.

Information will be treated as de-identified only after Furva has applied a de-identification process reasonably designed to prevent it from identifying a particular user or pet. Once information has been properly de-identified in accordance with applicable law, it is not considered personal information to the extent permitted by law.

AGGREGATED AND DERIVED DATA RIGHTS

Furva may create, generate, compile, and use aggregated, derived, statistical, and benchmarking information from data processed through the Service. Such information helps us improve the platform, develop new products and services, conduct research, generate insights, and support lawful business operations.

6.1 Aggregated Data: Furva may combine information from multiple users, pets, laboratory reports, and platform interactions to create aggregated datasets that do not reasonably identify any individual user or pet. Aggregated data may be used for analytics, research, trend analysis, product development, commercial insights, and other lawful business purposes.

6.2 Derived Data: Furva may create derived data based on information processed through the Service, including classifications, trends, correlations, observations, models, scores, summaries, patterns, and other information generated through analysis or processing activities. Derived data may be used to improve platform functionality, enhance user experience, develop new features, and support business operations.

6.3 Statistical Information: Furva may generate statistical information relating to platform usage, laboratory values, pet health trends, service performance, referral activity, user engagement, and other operational metrics. Statistical information may be used internally or shared externally in a manner that does not reasonably identify any individual user or pet.

6.4 Benchmarking Data: Furva may develop benchmarking datasets, comparative metrics, industry insights, trend reports, and other analytical resources using aggregated and derived information collected through the Service. Such benchmarking information may be used for research, product improvement, business intelligence, commercial purposes, and other lawful activities, provided that individual users and pets are not reasonably identifiable.

All rights, title, and interest in aggregated data, derived data, statistical information, benchmarking information, and similar datasets created by or for Furva shall belong exclusively to Furva, subject to applicable law and the rights expressly granted to users under our Terms of Service, Privacy Policy, and this Data Use Policy.

ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING IMPROVEMENT RIGHTS

Furva may use information processed through the Service to improve, evaluate, develop, and maintain artificial intelligence, machine learning, analytics, and related technologies, subject to applicable law and the provisions of this Data Use Policy.

7.1 AI Training and Improvement: Furva may use de-identified, anonymized, aggregated, transformed, statistical, benchmarking, and derived information to improve artificial intelligence systems, machine learning models, data extraction capabilities, analytical tools, and other platform technologies. Such activities may include model training, fine-tuning, testing, validation, performance optimization, and quality improvement. Once information has been properly de-identified in accordance with applicable law, Furva may use such information for artificial intelligence improvement, analytics, product development, and related business purposes as described in this Policy.

If Furva offers research studies, future research programs, or similar initiatives involving identifiable user information or identifiable pet information in connection with artificial intelligence development, participation in such activities will be subject to any applicable affirmative opt-in consent requirements.

7.2 Model Evaluation and Validation: Furva may use information derived from the Service to evaluate, validate, audit, monitor, compare, and measure the performance of artificial intelligence systems and related technologies. This may include assessing accuracy, reliability, consistency, bias mitigation, quality assurance, and system effectiveness. Such activities may utilize de-identified, anonymized, aggregated, statistical, benchmarking, and derived information without separate consent, provided the information does not reasonably identify an individual user or pet.

7.3 Accuracy Improvement Activities: Furva may analyze uploaded laboratory reports, extracted biomarker values, user corrections, feedback, error reports, and system outputs to identify inaccuracies, improve extraction performance, enhance analytical processes, strengthen quality controls, and improve overall platform accuracy and functionality. To the extent that such activities involve identifiable information as part of a research study, future research program, or similar initiative, and are beyond providing and improving the Service, Furva will obtain any consent required by applicable law.

7.4 Future AI Development Rights: Furva reserves the right to develop, acquire, license, integrate, deploy, and improve future artificial intelligence, machine learning, predictive analytics, decision-support, and related technologies using de-identified, anonymized, aggregated, transformed, or derived information where permitted by law and consistent with applicable user consents. Any future use of identifiable user information or identifiable pet information for research studies, future research programs, or similar initiatives will remain subject to applicable consent requirements and user choices.

Nothing in this Policy grants users ownership of Furva's artificial intelligence models, algorithms, methodologies, training processes, datasets, software, or related intellectual property. Any improvements, enhancements, discoveries, learnings, or developments resulting from such activities shall remain the exclusive property of Furva and its licensors.

RESEARCH, ANALYTICS, AND PRODUCT DEVELOPMENT

Furva may use information processed through the Service to conduct research, analytics, testing, quality assurance, business intelligence, and product development activities. These activities help us understand platform performance, improve user experience, develop new features, enhance artificial intelligence capabilities, identify trends, and support the Service's ongoing growth.

Furva may use de-identified, anonymized, aggregated, transformed, statistical, benchmarking, and derived information for internal and external research initiatives, analytics, benchmarking, operational improvements, artificial intelligence development, product development, commercial insights, and other lawful business purposes. Once information has been properly de-identified in accordance with applicable law, Furva may use such information for these purposes as described in this Policy and the Data Use Policy.

Furva does not currently require users to participate in identifiable-data research activities to access or use the Service. If Furva introduces research studies, future research programs, research partnerships, scientific initiatives, analytical projects, publications, or similar activities that involve identifiable user or pet information, participation in such activities will be entirely voluntary.

Users may choose whether or not to participate and may withdraw consent as permitted by applicable law.

Research, analytics, and product development activities may be conducted by Furva or by authorized service providers, contractors, consultants, academic partners, technology partners, research partners, or other organizations acting on Furva's behalf and subject to appropriate contractual, confidentiality, and data protection obligations.

Nothing in this Section limits Furva's rights to use de-identified, anonymized, aggregated, statistical, benchmarking, or derived information as otherwise described in this Data Use Policy.

COMMERCIAL USE OF DE-IDENTIFIED DATA

Furva may use, license, disclose, commercialize, sell, share, publish, distribute, or otherwise exploit de-identified, aggregated, statistical, benchmarking, transformed, and derived information for lawful business purposes. Such uses may include artificial intelligence development, research initiatives, industry reporting, market insights, benchmarking services, data analytics, product development, commercial partnerships, business intelligence, and other revenue-generating activities.

Once information has been properly de-identified in accordance with applicable law and no longer reasonably identifies a user or pet, Furva may use and commercialize such information as described in this Policy without obtaining separate user consent. This includes de-identified, aggregated, benchmarking, statistical, transformed, and other derived datasets.

Furva will not knowingly sell or disclose information that directly identifies an individual user or pet as part of these activities. Any commercial use of data under this Section will be limited to information that has been de-identified, anonymized, aggregated, transformed, or otherwise processed so that it does not reasonably identify you or your pet.

All rights, title, and interest in such de-identified, anonymized, aggregated, statistical, benchmarking, and derived datasets shall remain exclusively owned by Furva, subject to applicable law and any rights expressly granted to users under our governing agreements.

WHAT FURVA WILL NOT DO

Furva is committed to responsible data practices and transparency regarding how information is used. While we may use de-identified, anonymized, aggregated, and derived information as described in this Policy, we do not engage in certain activities involving identifiable user information.

10.1 No Sale of Identifiable Personal Information: Furva does not sell identifiable personal information, such as names, email addresses, phone numbers, account credentials, or other information that directly identifies individual users, to data brokers, advertisers, or unrelated third parties for their independent marketing purposes.

10.2 No Sale of Identifiable Pet Health Data: Furva does not sell identifiable veterinary laboratory reports, pet health records, biomarker data, AI-generated summaries, or other identifiable pet-related information to third parties. Any use of pet-related information for research, analytics, artificial intelligence improvement, benchmarking, or commercial purposes will be conducted only in accordance with this Policy, applicable law, and any required user consent.

10.3 No Unauthorized Advertising Uses: Furva does not use identifiable user information or identifiable pet health information to facilitate third-party behavioral advertising, targeted advertising, or advertising networks without appropriate authorization and any required consent.

We do not permit third parties to use information collected through the Service for their own independent advertising purposes except as expressly disclosed to users and permitted by applicable law.

THIRD-PARTY SERVICE PROVIDERS AND AI PROVIDERS

Furva relies on third-party service providers, infrastructure providers, artificial intelligence providers, communication providers, and other technology partners to operate, maintain, secure, and improve the Service.

These providers may process information on our behalf for purposes such as hosting, storage, authentication, customer communications, artificial intelligence processing, diagnostics, monitoring, security, analytics, and other operational functions. Current providers may include cloud infrastructure providers, database providers, email delivery providers, monitoring services, and artificial intelligence providers such as Anthropic.

Information shared with such providers is limited to what is reasonably necessary for them to perform authorized services on our behalf. We require service providers to process information in accordance with applicable law, contractual obligations, confidentiality requirements, and appropriate security standards.

Furva may add, replace, or discontinue service providers and technology partners from time to time as our business and technology needs evolve.

VETERINARY PARTNERS, REFERRALS, AND TELEHEALTH PROGRAMS

As part of its services, Furva may establish relationships with veterinarians, veterinary clinics, telehealth providers, pharmacies, laboratories, appointment-scheduling providers, referral partners, and other organizations that support pet health services.

Where requested by a user or necessary to facilitate a service, Furva may share relevant information with participating partners for purposes such as appointment scheduling, referral coordination, consultations, telehealth services, follow-up care, product recommendations, and related activities.

Furva may receive referral fees, commissions, revenue-sharing payments, or other compensation in connection with certain referrals, consultations, products, services, or partner relationships. Any such arrangements will not alter the ownership rights described in this Policy.

As Furva expands its services, additional veterinary networks, referral programs, telehealth partnerships, and related service offerings may be introduced. Information may be used and shared as reasonably necessary to facilitate these services, subject to applicable law, user consents, and the protections described in our governing policies.

DATA RETENTION AND RETENTION OF ANONYMIZED DATASETS

Furva retains information for as long as reasonably necessary to provide the Service, maintain user accounts, comply with legal obligations, resolve disputes, enforce agreements, protect our rights, and support legitimate business operations.

Identifiable user information, pet information, laboratory reports, AI-generated outputs, consent records, communications, and related data may be retained in accordance with our Privacy Policy and applicable legal requirements.

In addition, Furva may retain de-identified, anonymized, aggregated, transformed, statistical, benchmarking, and derived datasets indefinitely where permitted by applicable law. Such datasets may continue to be used for research, analytics, artificial intelligence improvement, product development, benchmarking, commercial purposes, and other lawful business activities.

The deletion of an account, withdrawal of consent, or removal of identifiable information will not require Furva to delete or modify information that has already been de-identified, anonymized, aggregated, incorporated into analytical datasets, used in research, or integrated into artificial intelligence models, systems, or product improvements, to the extent permitted by law.

BUSINESS TRANSFERS, INVESTMENTS, AND ACQUISITIONS

Furva may disclose, transfer, assign, or otherwise make available information and related rights as part of a merger, acquisition, financing transaction, investment transaction, asset sale, corporate reorganization, change of control, bankruptcy proceeding, or other business transaction.

Information may also be shared with prospective investors, lenders, strategic partners, acquirers, professional advisors, and other parties involved in evaluating, negotiating, or conducting due diligence relating to a proposed transaction. Such disclosures may include identifiable information, de-identified datasets, aggregated information, analytics assets, artificial intelligence assets, intellectual property, and other business records, subject to appropriate confidentiality obligations and legal protections.

Furva's rights in de-identified, anonymized, aggregated, statistical, benchmarking, derived, and artificial intelligence-related datasets may be transferred, licensed, assigned, or otherwise conveyed as part of any business transaction permitted by applicable law.

Any successor entity acquiring Furva or substantially all of its assets may continue to use information in a manner consistent with this Data Use Policy, the Privacy Policy, applicable user consents, and applicable law.

USER RIGHTS AND REQUESTS

Furva respects users' rights regarding their information and provides mechanisms for submitting requests for data access, deletion, consent preferences, and data portability, subject to applicable law and verification requirements.

To protect user privacy and security, Furva may require reasonable identity verification before processing a request. Certain requests may be limited where information must be retained to comply with legal obligations, enforce agreements, protect rights, maintain security, or support legitimate business operations.

15.1 Access Requests: Subject to applicable law, users may request information regarding the personal information Furva maintains about them, including categories of information collected, sources of information, purposes of processing, and categories of third parties with whom information has been shared.

15.2 Deletion Requests: Users may request deletion of their personal information, subject to applicable legal exceptions and retention requirements. Upon receipt of a verified request, Furva will take appropriate steps to delete or anonymize information where required by law. Deletion requests will not require Furva to delete de-identified, anonymized, aggregated, statistical, benchmarking, derived, or other information that no longer reasonably identifies a user or pet.

15.3 Consent Withdrawal Requests: Where data processing is based on consent, users may withdraw consent at any time. Withdrawal of consent will apply to future processing activities and will not affect the lawfulness of processing conducted before the withdrawal became effective. Withdrawal of consent will not require Furva to reverse, remove, or modify information that has already been incorporated into de-identified datasets, analytics, research activities, artificial intelligence systems, benchmarking information, or product improvements, to the extent permitted by applicable law.

15.4 Data Export Requests: Where required by applicable law, users may request a copy of certain personal information in a structured, commonly used, and portable format. Furva will respond to verified portability requests in accordance with applicable legal requirements and technical feasibility.

Requests relating to this Data Use Policy may be submitted using the contact information provided in this Policy or through other methods made available by Furva.

POLICY CHANGES

Furva may update, revise, or modify this Data Use Policy from time to time to reflect changes in our business practices, technology, artificial intelligence systems, legal requirements, data use activities, service offerings, or operational needs.

When we make material changes to this Policy, we may provide notice through the Service, by email, through account notifications, or by other reasonable means consistent with applicable law. The updated version will take effect on the date indicated in the revised Policy, unless otherwise required by law.

Your continued use of the Service after the effective date of an updated Policy constitutes your acknowledgment of the revised Data Use Policy. If you do not agree with any changes, you should discontinue use of the Service and follow any available procedures for account closure or consent withdrawal.
